This Privacy Policy (hereinafter "Policy") applies to all personal data processed in connection with the use of the Skuads Service (web application, iOS and Android mobile applications, API, generated websites and related integrations).

Role distinction:

• For data relating to Service users (Accounts, settings), SKUADS acts as the data controller.
• For data relating to the User's end customers, prospects, contacts, SMS recipients or callers, SKUADS acts as a data processor and the User acts as the data controller. The User is responsible for fulfilling information and consent obligations towards their own end users.

Depending on the subscription plan and Service configuration, the following categories of data may be processed:

3.1. Account and identity data

First name, last name, email address, phone number, company name, role, profile photo, language and User preferences.

3.2. Usage and browsing data

Login history, activity logs, preferences, settings, actions performed within the Service, IP address, device type, browser, cookies and similar technologies.

3.3. Integration and connected account data

Access identifiers and tokens for third-party accounts connected by the User (advertising accounts, local presence, social networks, etc.) via secure authentication protocols.

3.4. Content and media

Files, images, videos, texts, message templates, configurations and any content imported or generated by the User through the Service.

3.5. Communication and messaging data

Contact lists, audience segments, email and SMS campaign histories, tracking data (opens, clicks, unsubscribes), consent status (opt-in/opt-out).

3.6. Call tracking data

Inbound call histories, caller phone numbers, call recordings and transcriptions (only where the feature is enabled). The User is responsible for informing callers and obtaining necessary consents in accordance with applicable regulations.

3.7. Analytics and performance data

Data from connected analytics and advertising integrations (views, clicks, calls, reviews, positions, etc.).

3.8. Support data

Messages, attachments and exchanges in the context of technical support requests addressed to the Publisher.

3.9. Data transmitted to AI models

When using content generation features, data entered by the User (briefs, texts, public website URLs) may be transmitted to artificial intelligence models. Such data is used solely to produce the requested outputs and is not used to train third-party models.

Data is shared with third-party technical providers only to the extent necessary to provide the Service. Depending on the configuration and integrations activated by the User, this may include:

• Online advertising and local presence services — analytics, advertising and local presence management.
• Social media platforms — content publishing and management.
• Call tracking solution — inbound call tracking, recordings and transcriptions.
• Artificial intelligence models — AI-assisted content generation.
• Message sending providers — SMS and email campaign sending.
• Hosting and infrastructure providers — application and data hosting.
• Support and monitoring tools — incident management, application performance tracking.

Some providers may process data outside the European Union. In such cases, transfers are governed by appropriate safeguards, including:

• standard contractual clauses adopted by the European Commission;
• where applicable, an adequacy decision recognising a sufficient level of protection in the destination country.

No personal data is retained beyond what is strictly necessary for the operation of the Service.

Account deletion: The User is free to delete their Skuads account at any time from their profile settings. Deleting the account results in the immediate and permanent deletion of all associated personal data — profile, history, generated content, campaign data — with no possibility of recovery.

The Service uses cookies and similar technologies (pixels, local storage, etc.) for its operation, security and audience measurement. Cookies strictly necessary for the Service to function do not require consent. Non-essential analytical or audience measurement cookies may be subject to prior consent in accordance with applicable ePrivacy regulations.

The Publisher implements appropriate technical and organisational measures to protect data against unauthorised access, loss, alteration or disclosure, including:

• communications encryption (HTTPS/TLS);
• access control and management (authentication, Workspace isolation);
• logging of access and sensitive actions;
• regular data backups.

As no security measure is absolute, the Publisher cannot guarantee total protection against all breaches. In the event of a personal data breach likely to result in a high risk, the Publisher undertakes to inform the affected individuals and, where applicable, the relevant supervisory authority within the legally required timeframes.

Under Regulation (EU) 2016/679 (GDPR) and applicable national data protection law, you have the following rights regarding your personal data:

• Right of access (Art. 15 GDPR): obtain a copy of the data concerning you.
• Right to rectification (Art. 16 GDPR): correct inaccurate or incomplete data.
• Right to erasure (Art. 17 GDPR): request deletion of your data, subject to legal retention obligations.
• Right to restriction of processing (Art. 18 GDPR): request temporary suspension of processing.
• Right to object (Art. 21 GDPR): object to processing based on legitimate interest.
• Right to data portability (Art. 20 GDPR): receive your data in a structured, machine-readable format.
• Right to withdraw consent: withdraw consent at any time without affecting the lawfulness of prior processing.

To exercise these rights, send your request to: support@skuads.com. Proof of identity may be requested. You will receive a response within one (1) month of receipt of your complete request.

If you believe that the processing of your data does not comply with applicable regulations, you have the right to lodge a complaint with the competent supervisory authority. The Service is exclusively intended for professionals and is not designed for use by persons under eighteen (18) years of age. The Publisher does not knowingly collect personal data relating to minors.

The Publisher reserves the right to update this Policy at any time to reflect changes to the Service, legislation or its practices. In the event of a material change, Users will be informed by appropriate means (email, in-Service notification) with reasonable notice before the new version takes effect.
